1. Introduction

This Privacy Statement (“Statement”) explains to users of the mobile applications and websites powered by CASHYT (collectively, defined as our "Services"), how CASHYT S.A. gathers and uses information collected in connection with the use of our Services and CASHYT Apps. In this Statement, the terms "CASHYT", "we" and "us" refer to CASHYT S.A. The terms "User", “your” or "you" mean any person using our Services, whether by browsing a website powered by CASHYT or installing and using any App developed by CASHYT.

By accessing or using our Services and any other CASHYT App, you acknowledge that you have read, understood, and agreed to be bound by this Privacy Statement and our Terms and Conditions. If you do not agree to these terms, do not use our Services.

Websites and Apps that are owned and operated by CASHYT may contain links to websites that are owned and operated by other companies. This Statement does not apply to websites and services that are owned, operated and ruled by third parties.

2. Information We Collect

When you use our Services, we may collect certain information about you and the services you use. The information we collect falls into three different categories: personal information you give us; information we collect from you when you use our Services; and information we collect from other sources.

Personal Information You Give Us

We may collect information when you create an account in any of our Apps, or when you use any of our websites, or any other of our Services. The information you give us may include your name, phone number, password, email address, postal address, date of birth, gender, city, country and any other information you choose to share with us. You do not have to provide Personal Information to CASHYT, but you may not be able to take advantage of all the features in our Services if you do not.

Information We Collect When You Use Our Services

When you use our Services, we may collect information about the Services you use and how you use them. This information includes:

  • Phone Contact List – with your permission, we may collect information about your Phone Contact List to see which of your friends are also using the App;
  • Facebook Contact List – with your permission, when you login to Facebook, we may collect information from your Facebook Contact List to see which of your friends are also using the App;
  • Invited Friends – we may collect information about the friends you do invite through our “Tell-a-Friend” program;
  • Rewards Information – we may collect information about the rewards you receive inside our Apps;
  • Loyalty Cards information – we may collect information about the digital loyalty cards you maintain inside our Apps;
  • Check-in Information - we may collect information about the stores and locations you have visited and checked-in using our Apps;
  • Purchase Information – we may collect information about the stores and retailers where you purchased a product or service and we received a QR code that was redeemed in our App. We may also collect information about the transaction itself, including the approximate amount, date and location of the transaction;
  • Device and Website Use Information – when you install one of our mobile Apps or use a computer, tablet, smartphone or other device to access our Services, we may collect information about the device and how you use it. This information may include the type of device, your operating system, your browser, your Internet Service Provider, your Internet Protocol (IP) address, the date and time that you accessed our Services, the website that referred you to our Services, the web pages you requested and the date and time of those requests. To collect this information, we may use cookies, beacons, pixel tags, clear gifs or similar technologies. You may be able to modify your browser settings to alter which web-tracking technologies are permitted when you use our Services, but this may affect the performance of these Services.
  • Location Information – When you use a smartphone or another mobile device to access our Apps, or you use a computer or another device to access any of our websites, we may collect information about your physical location. We may combine this information with other location-based information, such as your IP address and postal code, to give you information about stores and promotions nearby and to provide you with other services on your mobile device. We share your location information only with companies that help us provide you with services and help us understand how the services are being used.
  • Information We Collect from Other Sources - We also collect information that is publicly available. For example, we may collect information you submit to social networks like Facebook, Instagram, Twitter or Google+. By gathering additional information about you, we can correct inaccurate information and give you product recommendations and special offers that are most likely to interest you.

3. How Do We Use and Share The Information We Collect

In this section, we explain what we do with the information we collect, the level of information we share and how you can limit this sharing.

Personal Information: CASHYT will use and store your Personal Information to deliver our Services to you (through our mobile Apps and websites); to send email messages with updates about our Services; to improve our products and Services; to investigate (and remedy) fraudulent or allegedly fraudulent activity; and to perform aggregated data analysis. Additionally, any Personal Information that we collect via Facebook will be used for open graph posts.

We will never disclose your email address, transaction history, or other Personal Information to merchants or any other third party for their marketing purposes without you first authorizing that merchant or third party to access such information. This allows you to use the CASHYT Services and CASHYT Apps in a secure way and prevent unwanted marketing.

CASHYT will disclose your Personal Information to third parties only in the following limited circumstances:

  • CASHYT may share your information with service providers that provide us support services, such as website hosting, email delivery, push notification delivery, SMS message delivery, location-mapping, postal mail processing and delivery, and analytics services. We will ensure, to the largest possible extent, that companies only collect, use and disclose your information when it is mandatory in performing work for us or when the disclosure of your information is required by law;
  • CASHYT may allow our contractors, who are delivering rewards and merchandising, managing promotions, analyzing data and usage of the Service, providing support and maintenance services for our Services, or providing customer service, to access Personal Information. We require contractors to use the Personal Information they access only in connection with the services they perform for CASHYT, and never for any marketing or other purposes. Our contractors have to sign a Confidentiality Agreement with us and will always be required to maintain the confidentiality of your Personal Information in accordance with this Privacy Statement;
  • If you are a winner of a sponsored league competition (as detailed in the applicable League Rules), we will share your contact information for purposes of prize fulfillment only.
  • If you are a winner of a league competition, we may use your username and profile image in our Social Media announcements. In case you do not agree, please contact us.

Aggregate Information: CASHYT may also use Personal Information to create aggregated data for analytical purposes. This statistical information does not contain any individual-identifying information or contact information and it is only used to understand our customer base as a whole and to provide a better service. CASHYT reserves the right to share such aggregated, non-identifiable data with third-parties.

Web and Mobile Tracking Information: CASHYT uses web and mobile tracking information to manage our Services, to understand how well our Services are working and to develop and aggregate statistical information about the use of our Services. CASHYT may disclose web and mobile tracking information, without individual identifying Personal Information, to third party companies and contractors, in order for such third parties to analyze the performance of our Services and the behavior of users, to operate and improve our Services.

Email Communications: If you create a CASHYT User Account in any of our Apps or if you provided your email address in any of our websites, we will send you administrative and promotional emails concerning the CASHYT Service, including new software releases, new features, promotions, competitions and rewards and to respond to your customer service inquiries and requests for information. If you wish to opt out of promotional emails, you may do so by following the "unsubscribe" instructions in the email or by contacting CASHYT Support.

Network Operators: Use of our Services may involve use of the services of third-party telecommunications carriers and Internet service providers. Any information that a carrier or an Internet service provider collects in connection with your use of our Services is not Personal Information and is not subject to this Privacy Statement. CASHYT is not responsible for the acts or omissions of any telecommunications carriers or Internet service providers.

Additional Disclosures: Notwithstanding anything to the contrary in this Privacy Statement, CASHYT reserves the right to use or disclose Personal Information and any other information we collect in connection to our Services: (a) if we become involved with a merger, acquisition or a similar situation which involves the transfer of some or all of our business assets as may share your information with business entities or people involved in the negotiation or transfer; (b) to any law enforcement, judicial authority, or governmental or regulatory authority, to the extent required by law or legal process; or (c) if in CASHYT's reasonable discretion, such use or disclosure it is necessary to enforce or protect CASHYT's legal rights or to protect the legal rights of third parties.

4. Privacy Settings Opt Out

In this section, we explain how you can opt-out and take actions regarding the sort of information you make available to CASHYT.

You can opt-out of receiving promotional emails, text messages or chat messages within our Apps by modifying your promotional preferences in your Account’s profile section, by adjusting your text and notification preferences in your mobile device's settings or by following the opt-out instructions in the promotional emails we send you.

You can also make some decisions about the information we collect about you, namely, location information and the use of cookies:

  • Location Information – When you use a smartphone or another mobile device to access our Services, we may collect information about your physical location only if: "location services" for the mobile App is enabled and the permissions in the mobile device allow communication of this information. If you do not want us to collect your location information, you can opt-out of sharing this information by disabling the location services for our Apps in your mobile device;
  • Cookies – – If you want to reject cookies, you must choose to inactivate them in your browser. Every browser has a preference or option you can configure so that the browser notifies you if a site wants to set a cookie and typically provides with an option to accept or reject the cookie before the cookie is set. If you choose to remove or reject cookies, it will affect many features or services on our websites. If you want to learn the correct way to modify your cookie settings, please use the Help menu in your browser.

5. Deleting Your Account

If you would like to cancel your Account and your Personal Information to be permanently removed from our database, please contact us using the information in the "Contact Us" section below. We will make every effort to promptly respond to your request and we will disable your CASHYT User Account from any of our Apps and you will no longer receive emails from CASHYT. We will retain your information only for as long as your Account is active or as needed to provide you with our Services. If you ask us to delete your account, we generally retain and use your Account information only as long as necessary to fulfill a business or law enforcement need.

6. How We Protect Your Information

CASHYT protects your information using technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information. Some of our safeguards include firewalls, data encryption, physical access controls and administrative informational controls. When you transmit highly-sensitive information through our website or in one of our mobile Apps, we encrypt the transmission of that information using the Secure Sockets Layer (SSL) protocol. Although we have employed security technologies and procedures to assist safeguarding your Personal Information, please be aware that no system or network can be guaranteed to be 100% secure. No Internet transmission is completely secure, and we cannot guarantee that security breaches will not occur. Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties.

7. Use by Minors

Our Services cannot be used by anyone under the age of 13 years old. If CASHYT learns that Personal Information of users less than 13 years of age has been collected without verifiable parental consent, then CASHYT will take the appropriate steps to promptly delete this information. If you are a parent or guardian and believe we may have collected information about a child, please let us know using the information in the "Contact Us" section below.

8. Facebook Connect

If you connect to the CASHYT Service using Facebook Connect, you agree that any identifying information obtained by us by reason of your connection using Facebook Connect will constitute Personal Information for the purposes of this Privacy Statement, and you consent to our use and disclosure of such information in accordance with this Policy. If we stop using Facebook Connect as an access mechanism, you agree that we will nevertheless retain any Personal Information in accordance with this Statement.

9. Changes to This Privacy Statement

This Statement went into effect on the date noted at the top of this webpage. We may update this Statement from time to time. If we make material changes, we will post the updated Statement on this page and change the date at the top of this webpage. We encourage you to look for updates and changes to this Statement by checking the date at the top of this webpage. We will notify you of any modifications to this Statement that might materially affect the way we use or disclose your Personal Information prior to the change becoming effective, by means of a message on this website.
